Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using BeaverPlot ("the App"), you agree to be bound by these Terms of Service ("Terms"). The App is operated by Glucoplate Inc., a corporation incorporated under the laws of the Province of Alberta, Canada ("we", "us", or "the Company"). If you do not agree to these Terms, do not download, install, or use the App.

2. Description of Service

BeaverPlot is a mobile application that uses LiDAR scanning technology to generate parametric 3D models of interior spaces, exportable to industry-standard formats including IFC, DXF, PDF, and USDZ. The App is designed as an estimation and scanning aid tool only.

3. Accuracy Disclaimer

THE APP IS INTENDED SOLELY AS A SCANNING AID AND ESTIMATION TOOL. LiDAR-based measurements are approximations and may contain errors or inaccuracies due to environmental conditions, device hardware limitations, surface materials, lighting conditions, room geometry, and other factors beyond our control.

ALL MEASUREMENTS, MODELS, FLOOR PLANS, AND OTHER OUTPUTS GENERATED BY THE APP MUST BE INDEPENDENTLY VERIFIED WITH PHYSICAL MEASUREMENTS BY A QUALIFIED PROFESSIONAL BEFORE USE IN ANY APPLICATION, including but not limited to: construction, renovation, architectural design, permitting, building code compliance, real estate transactions, insurance claims, structural engineering, interior design, or any other context where dimensional accuracy is required or assumed.

The calibration feature may improve accuracy but does not guarantee it. Users are solely and entirely responsible for verifying the accuracy of all outputs produced by the App.

4. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND DEFECTS, WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Title and non-infringement
  • Accuracy, reliability, or completeness of any measurements, models, or outputs
  • Uninterrupted, timely, secure, or error-free operation
  • That results obtained from the App will be accurate or reliable
  • That defects will be corrected

No advice or information, whether oral or written, obtained from the Company or through the App shall create any warranty not expressly stated in these Terms.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GLUCOPLATE INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (including but not limited to damages for loss of profits, revenue, data, goodwill, or other intangible losses) arising out of or in connection with:

  • Your use of or inability to use the App
  • Inaccurate measurements, models, floor plans, or any other outputs generated by the App
  • Reliance on App-generated data for construction, renovation, design, permitting, or any other purpose
  • Errors in construction, design, or permitting resulting from the use of App outputs
  • Property damage, personal injury, or financial loss arising from reliance on App outputs
  • Loss of scan data, project files, or exported files
  • Interruption or unavailability of export processing services
  • Unauthorized access to or alteration of your data
  • Any third-party conduct or content

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if the Company has been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law.

6. Indemnification

You agree to indemnify, defend, and hold harmless Glucoplate Inc., its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the App; (b) your reliance on any measurements, models, or outputs generated by the App; (c) any construction, design, or other work performed based on App outputs; (d) your violation of these Terms; or (e) your violation of any applicable law or regulation.

7. Assumption of Risk

You acknowledge and agree that the use of LiDAR scanning technology for measurement purposes involves inherent limitations and risks. By using the App, you assume all risk associated with the accuracy and reliability of App-generated measurements and models. You agree that it is your sole responsibility to engage qualified professionals to verify all measurements and outputs before relying on them for any purpose.

8. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the App
  • Abuse, overload, or interfere with the export processing servers
  • Use the App for any unlawful purpose
  • Attempt to bypass device attestation or API security measures
  • Use the App outputs as the sole basis for any professional certification or building code compliance without independent verification

9. Intellectual Property

The App, including its design, source code, branding, and documentation, is the property of Glucoplate Inc. and is protected by Canadian and international intellectual property laws. Scan data and exported files you create using the App are yours. We claim no ownership over your content.

10. Service Availability

Server-side export processing (IFC, DXF, PDF) requires an internet connection and depends on our backend infrastructure. We do not guarantee uninterrupted or error-free availability of the export service and may modify, suspend, or discontinue the service at any time without notice or liability. USDZ exports are processed on-device and do not require a server connection.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms or the App shall be subject to the exclusive jurisdiction of the courts of the Province of Alberta, Canada.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms. Material changes will be posted on this page with an updated revision date.
